Who gains custody of Archie and Lilibet after Harry and Meghan are gone? That’s what a lot of fans can’t help but wonder, especially after hearing that the Sussexes were involved in a high-speed car chase throughout New York City on Tuesday night. Here’s what you need to know.

According to reports, the Duke and Duchess of Sussex alleged that they were in a “near catastrophic” paparazzi car chase in New York City. Thankfully, no one got hurt. But the near incident has prompted a lot of people to wonder where Archie and Lilibet would live, should they lose both of their parents.

While Queen Elizabeth was still alive, it was said that all of her children, grandchildren and great grandchildren technically belong to her. And now that King Charles is King of England, there’s a very good chance that the same rule applies to him, too. Even though Prince Harry and Meghan Markle are Archie and Lilibet’s biological parents, King Charles is the one who technically has custody of the Sussex kids. 

Royal expert Marlene Koenig once put it this way, “The sovereign has legal custody of the minor grandchildren. Legislation passed during the reign of George I. It was known as The Grand Opinion for the Prerogative Concerning the Royal Family and it was about the King’s control over the education, the raising and the marriage of his grandchildren. He did it because he had a very poor relationship with his son, the future King George II, so they had this law passed that meant the King was the guardian of his grandchildren.”

She continued, “The monarch’s right of supervision extended to his grandchildren and this right of right belongs to His Majesty, King of the Realm, even during their father’s lifetime.”

Does King Charles Have Custody Of The Entire Royal Family?

So should anything happen to Harry and Meghan, that means the kids would be given to King Charles. However, some people on Twitter seem to disagree. Some have commented with, “My guess would be that their wills have the children going to Doria and then perhaps the Spencers. I can’t imagine Harry wanting his children in England, especially if he’s not around to care for them. But a chill is down my spine as well,” along with, “I’m sure they have clear-clut plans in their wills, etc., for custody and that the Windsors aren’t it.  But it would likely be messy for numerous reasons.  Pretty horrific.”

Another critic wrote, “It would turn into an international custody issue.  Who would take on a KING with blood ties to those babies?  And don’t all royal children belong to the Crown?”
